General Terms and Conditions for Orders in the EDELFUNDE Online Shop

1. Scope and Contracting Parties
These General Terms and Conditions apply to the purchase of goods by consumers in the EDELFUNDE online shop. Consumers are natural persons who order predominantly for private purposes.

2. Products, Individual Items and Sets
We offer minerals, crystals and related goods. The essential characteristics and the scope of delivery are set out in the respective product description.
For minerals expressly offered as individual items, you will receive exactly the specimen shown. For sets, tumbled stones and bulk offers, the product description states whether the photos show the actual items to be delivered or examples, and what quantity or weight is included in the offer.
Minerals may have natural inclusions, color variations, irregular shapes or other characteristic features. The description and photos are intended to reflect the condition of the item offered. Any treatment, such as polishing or dyeing, is stated in the respective product description. Natural characteristics and possible differences in screen display do not justify a blanket exclusion of your statutory rights to complain about defects.
3. Ordering and Conclusion of Contract
The presentation of products in the online shop is an invitation to place an order. You can initially add items to the shopping cart without obligation. Before submitting, you can check and change the items, quantities, delivery address and other details using the provided functions.
By clicking the final order button, which clearly indicates the obligation to pay, you make a binding offer to purchase. For express payment methods, you check and confirm your order during the respective ordering process.
We will immediately confirm receipt of your order by email. A mere confirmation of receipt does not constitute acceptance of the contract unless it expressly contains a declaration of acceptance.
The contract is concluded as soon as we expressly accept your offer by email, ship the goods, or capture the payment amount using the payment method you selected. The event that occurs first is decisive. A mere payment authorization or reservation does not constitute collection. We will accept your offer no later than three calendar days after receipt of the order; if no acceptance is made within this period, you are no longer bound by your offer. Your statutory right of withdrawal remains unaffected.
If an ordered individual item is not available, we will inform you immediately. We will not deliver a different specimen without your consent. We will immediately refund any payments already made for goods not delivered; your further statutory rights remain unaffected.
4. Contract Language and Contract Documents
The contract language is German. We store your order data. You can save or print these General Terms and Conditions and the order information displayed before conclusion using your browser's functions.
You will receive the contract confirmation containing the order data, the General Terms and Conditions valid at the time the contract is concluded, and the withdrawal policy including a model withdrawal form on a durable medium, in particular by email, within a reasonable time after the contract is concluded and no later than upon delivery. Please keep these documents. We do not guarantee permanent online access to the full contract text.
5. Prices, Shipping Costs and Payment
All prices are final prices in euros. Where VAT is legally applicable, it is included in the displayed price. Additional shipping costs will be shown at the time of ordering before it is completed. You can find the shipping costs and thresholds for free shipping under Shipping & Delivery.
For free delivery, the value of the goods after deducting discounts and excluding shipping costs is decisive, unless otherwise stated in a specific promotion.
The payment methods displayed during the ordering process are available. The payment process follows the selected method. Unless a different payment deadline is expressly displayed, payment is due upon conclusion of the contract. An authorization may take place at the time the order is placed.
6. Delivery and Delivery Times
We ship from Bulgaria to the delivery addresses approved during the ordering process within the European Union. The shipping methods and costs available for a delivery address are displayed before the order is completed.
Preparation of the order takes up to two business days. This is followed by the respective transport time. Under Shipping & Delivery, the transport times from dispatch are listed; the processing time is in addition. Business days are Monday to Friday, excluding public holidays. An estimated delivery date displayed during the ordering process takes into account the processing and transport times stated there.
If a different delivery time is stated for an item, that time applies. We will inform you of any known significant delays. Your statutory rights in the event of a delivery delay remain unaffected.
When shipping through a carrier offered by us, we bear the risk of accidental loss or damage until delivery to you or a third party designated by you who is entitled to receive it and is not the carrier.
7. Right of Withdrawal and Returns
Consumers generally have a statutory right of withdrawal of 14 days for these purchases. Details on the start of the period, exercise of the right, return costs and refunds, as well as the model withdrawal form, can be found under Withdrawal & Returns.
Minerals and crystals are delicate. Please use sturdy outer packaging for returns, cushion the pieces individually, and protect crystal points in particular. Original packaging is not required. These packaging instructions are not a prerequisite for exercising the right of withdrawal.
Any compensation for diminished value is based exclusively on statutory requirements. No blanket restocking or processing fee will be charged for a statutory withdrawal. Claims due to defective or damaged goods delivered are independent of the right of withdrawal.
8. Statutory Rights Regarding Defects and Transport Damage
Statutory rights regarding defective goods apply. The statutory warranty is at least two years from receipt of the goods; further mandatory rights and longer statutory periods under applicable law remain unaffected. An additionally offered voluntary guarantee does not limit these rights.
If an item arrives damaged or does not correspond to the agreed description, please contact us at kontakt@edelfunde.de. The order number and, if possible, photos of the item and the packaging will help us process your request. Please keep the packaging for the time being if possible. These requests do not establish an additional exclusion period and are not a prerequisite for your statutory claims.
In the event of justified claims regarding defects, we will bear the costs legally required of us, including necessary transport costs. The provision regarding return costs borne by the customer in the event of a standard withdrawal does not apply in this case.
9. Liability
Our liability is subject to statutory regulations. These General Terms and Conditions do not limit your statutory claims for damages.
10. Complaints and Out-of-Court Dispute Resolution
For complaints, you can contact the details listed in Section 1. We will endeavor to resolve the matter directly.
For consumer disputes with a trader based in Sofia, the General Mediation Commission at the Bulgarian Commission for Consumer Protection in Sofia is particularly relevant. Information on the procedure and application can be found at the Commission for Consumer Protection (KZP); contact details of the Mediation Commission: adr.sofia@kzp.bg.
If a complaint directed directly to us cannot be resolved, you will receive the legally required information on the competent dispute resolution body and whether we participate in the relevant procedure on a durable medium. This does not imply a general voluntary commitment to participate. Your right to appeal to a competent court remains unaffected.
11. Applicable Law and Data Protection
The statutory rules on applicable law and judicial jurisdiction apply. These General Terms and Conditions do not limit the mandatory consumer protection rights you are entitled to under applicable law.
